By creating an account or accessing the Callyd platform ("Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, you may not use the Service. If you are using the Service on behalf of a company or organisation, you represent that you have authority to bind that entity to these Terms.
2. Description of Service
Callyd provides an AI-powered voice agent platform that enables businesses to automate outbound calling, lead qualification, appointment setting, and related activities. Features, pricing, and availability may change at any time.
3. Eligibility
You must be at least 18 years old and legally capable of entering into a binding contract to use the Service. By using Callyd, you represent that you meet these requirements.
4. Account Registration
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised use of your account. We reserve the right to terminate or suspend accounts at our discretion.
5. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation, including telemarketing laws (e.g., TCPA, GDPR, CASL)
- Call individuals who have opted out, are on Do-Not-Call registries, or have not provided appropriate consent
- Harass, threaten, or harm any individual
- Transmit unsolicited bulk communications
- Reverse-engineer, decompile, or attempt to extract source code from the Service
- Introduce viruses, malware, or other harmful code
- Interfere with or disrupt the integrity or performance of the Service
You are solely responsible for ensuring your use of the Service complies with all applicable laws and regulations in your jurisdiction.
6. Fees and Billing
Access to certain features requires a paid subscription. All fees are stated in USD and are non-refundable except as required by law or expressly stated in our refund policy. We reserve the right to change pricing with reasonable advance notice. Failure to pay may result in suspension or termination of your account.
7. Intellectual Property
All content, features, and functionality of the Service — including software, text, graphics, logos, and designs — are owned by Callyd or its licensors and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to access and use the Service for your internal business purposes.
You retain ownership of content you upload to the Service. By uploading content, you grant Callyd a worldwide, royalty-free licence to use, process, and store that content solely to provide the Service.
8. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. Callyd does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee specific results from the use of the Service.
9. Limitation of Liability
To the fullest extent permitted by law, Callyd and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid to Callyd in the twelve (12) months preceding the claim.
10. Indemnification
You agree to indemnify, defend, and hold harmless Callyd and its affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights.
11. Termination
Either party may terminate these Terms at any time. You may cancel your account through the dashboard or by contacting support. We may suspend or terminate your access immediately if you violate these Terms. Upon termination, all licences granted to you will cease and you must stop using the Service.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Callyd is incorporated, without regard to conflict of law provisions. Any disputes shall be resolved through binding arbitration or in the courts of that jurisdiction.
13. Changes to Terms
We may revise these Terms from time to time. We will notify you of material changes by email or through the Service at least 14 days before they take effect. Your continued use of the Service following the effective date of any changes constitutes your agreement to the revised Terms.
